    1. State the rationale (reason for being) for the protection of civil rights.
The rationale for the protection of civil rights is to protect citizens of the nation from abuse. A civil right is what makes a citizen able to do something freely.

    2. Explain why the rationale is flawed.
The rational is flawed because not every citizen is protected from it. Sometimes the government is the one that takes it away from us.

    3. Propose an amendment. Justify your proposal.
There should be designated limit as to when a civil right is to be used so that it will not be abused. Without limitations, there will be many loopholes as to how to use a civil right. A civil right can be used as an excuse for a committed crime.

    1. State the rationale (reason for being) of the protection of civil rights.
The rationale for the protection of civil rights is to protect citizens of the nation from abuse. A civil right is what makes a citizen able to do something freely.

    2. Explain why the rationale is correct.
The rationale is correct because the civil rights are used by a citizen as a means to do an act freely for example the freedom of speech.

    3. Justify why civil rights must be guaranteed protection.
The civil rights must be guaranteed protection because these are gives a citizen freedom. Civil rights define a democratic government by giving a means of freedom to its citizens.

  2. Concurring opinion:
    1. State the rationale (reason for being) for the protection of civil rights.
-Everyone has their rights and freedom. People are free to express their ideas and beliefs. Civil rights are like the life of people. If they are taken away, it is like death. Not being able to speak and express is like a dead body. That is why the rights should be protected like living persons.

    2. Explain why the rationale is flawed.
-Sometimes the people giving and protecting the rights are removing it. The government sometimes removes the civil rights without any reason. They take away the freedom of expression for things unknown which is unfair. Everyone has their own power and rights but the government removes it just because they can.

    3. Propose an amendment. Justify your proposal.
-Place limitations and conditions for the removal of the civil rights. People must know their freedom but must also know the limitations of their freedom. They should know that they are free to do things as long as it abides laws and does not conflict with the freedom of others.

    Dissenting opinion:
    1. State the rationale (reason for being) of the protection of civil rights.
-Everyone has their rights and freedom. People are free to express their ideas and beliefs. Civil rights are like the life of people. If they are taken away, it is like death. Not being able to speak and express is like a dead body. That is why the rights should be protected like living persons.

    2. Explain why the rationale is correct.
-People do what they want to do. They live their own lives. They do not live other people’s lives so they should not interfere with others and live only their own. Rights and freedom are part of people’s lives. If taken away, it is like death, being unable to speak like a corpse. Protecting the rights is almost the same as protecting people’s lives.

    3. Justify why civil rights must be guaranteed protection.
-Civil rights give the people the power to do what they want. If these rights are removed, democracy loses its meaning. Democracy means the people have the freedom of speech and expression. If rights were removed, the government should have be other than democracy and that would be troublesome for the nation.

  5. A.Concurring Opinion:

    1. State the rationale (reason for being) for the protection of civil rights.
    >>Each and every man has a God given right and freedom. Civil rights protect each of us so that we can express ourselves freely. It gives life, from just doing what’s what and what’s there, from just existing.

    3. Propose an amendment. Justify your proposal.
    >>Too much of something is also bad, that’s why i think it is also better if we would consider some limits regarding these rights. Through which, both ends would meet halfway and abuse of rights would be avoided.

    >>The rationale is correct because it helps each citizen to express themselves freely, especially in pointing out unjust actions or measures by the government.

    3. Justify why civil rights must be guaranteed protection.
    >>It guarantees protection, since it gives us the chance to speak for ourselves. To do what is right, and what we think could make us all better. We all have our own rights, and this gives us the chance to exercise it.

  6. Concurring Opinion:

Civil Rights are rights given to a person to protect him from abuse and to let him live freely and without worry.

Having rights and liberties are essential to human beings; however, privileges always come with duties do they not. What if someone abuses his rights? Exercising rights abusively takes away rights of others.

This is why I believe that rights, though not completely abolished, should be limited. What one wants is not always what one needs.

    Dissenting Opinion:

Civil Rights are rights given to a person to protect him from abuse and to let him live freely and without worry. Having civil rights is making a person a PERSON. Shall a person’s civil rights be taken away from him it is the same as treating him like a thing.

Rights are essential to be human. Taking away one’s ability to decide takes away his intelligence, thus making him no more than an animal.

Since something like Civil Rights is essential for humans to survive as humans, it should not be abolished or limited.

  7. A.
Civil rights are given to us to ensure our safety from being harmed by any means of other people.
It is flawed because some persons may abuse their right in order to escape from punishment.
Place limitations on some rights for some situations so that abusing ones right would be avoided.
    B.
Civil rights are given to us to ensure our safety from being harmed by any means of other people.
Rights must be given to the people because the government’s duty is to protect their citizens from abuse.
Civil rights must not be abolished because we could not live a peaceful life without it.

  8. A.
Citizens of a nation are given civil rights so that they would be able to express their concerns and opinions without the fear of being persecuted or punished by the government, especially when they express their dis-satisfaction with the current government.

Each person is given freedom through their rights, but the freedom given is not absolute. There are still bounderies in which a person must act. There are some who abuse this freedom and they end up unpunished due to using excuses like “we have the right to this… and that…”.

People must be informed of these limitations. They must be educated on what is within and outside the limits of the freedom given to them by their rights.

    B.
Citizens of a nation are given civil rights so that they would be able to express their concerns and opinions without the fear of being persecuted or punished by the government, especially when they express their dis-satisfaction with the current government.

The people are given their rights because it truly shows that the country is free and that the citizens are given the freedom to do as they please. It shows that the government treats the people as part of the sovereignty of the country.

These civil rights should be given protection because they are the lifeblood that keeps the country afloat. It is the proof of the democracy of the country towards it’s citizens. Removing these rights would end up killing that democracy, and in the end, killing the country.

  9. CONCURRING OPINION

State the rationale (reason for being) for the protection of civil rights
    – We, as citizens, have been given civil rights to express our beliefs, ideas or opinions. Article III (Bill of Rights) was enacted to protect these rights.

Explain why the rationale is flawed.
    – The government itself takes away these rights. The law does not always guarantee our security and protection. For reasons unclear to us, those who protect us even suppress our freedom to express or worse deprive us of this right. This is the reason why the rationale is flawed.

Propose an amendment. Justify your proposal.
    – This law should be amended by enforcing limitations on how citizens would utilize the civil rights granted to them.

    DISSENTING OPINION

State the rationale (reason for being) of the protection of civil rights.
    – We, as citizens, have been given civil rights to express our beliefs, ideas or opinions. Article III (Bill of Rights) was enacted to protect these rights.

Explain why the rationale is correct.
    – The rationale is correct in a sense that living in a democratic country, citizens are granted the freedom to express themselves. It is a primary characteristic of democracy. Depriving them of this right would ultimately destroy the concept of democracy.

Justify why civil rights must be guaranteed protection.
    – Just as life should be preserved and protected, the same should be with civil rights. The freedom of expression is the very definition of a rational being. Depriving him of these rights would leave him as an object – a tool manipulated and abused unable to speak for himself.

  10. Concurring opinion:

Every man is entitled to freedom and the civil rights help achieve this freedom. Protection of civil rights is enacted so that people will be free of fear that someone might prosecute them for expressing their ideas/beliefs.

The rationale is flawed because the government sometimes takes it away (just like during the Marcos regime). Civil rights help the people achieve their freedom but it doesn’t always guarantee protection from an abusive government.

It should clearly set the boundaries of the people’s freedom to prevent its abuse. And the individuals should be responsible enough to abide by these limitations.

    Dissenting opinion:

Every man is entitled to freedom and the civil rights help achieve this freedom. Protection of civil rights is enacted so that people will be free of fear that someone might prosecute them for expressing their ideas/beliefs.

The rationale is correct because the civil rights help people utilize their freedom without fear.

The civil rights must be guaranteed protection because no one should take away the freedom of another. It will also give an individual the reassurance that no one can condemn him/her if he/she utilizes his/her freedom.

  11. Concurring opinion:
    1. State the rationale (reason for being) for the protection of civil rights.
Civil rights are those that provide liberty on each citizen of the state. With these civil rights come duties and obligations so as to balance the power of every person and for him to avoid its abuse.

    2. Explain why the rationale is flawed.
It is flawed because it is always abused by other people to escape some accusations and cases against them

    3. Propose an amendment. Justify your proposal.
The government should set a limitation on the Civil Rights of every person especially during criminal cases.
    Dissenting opinion:

One of the essential factors for every human to live are his rights. These rights give man freedom but not absolute because of some obligations.

    3. Justify why civil rights must be guaranteed protection.
Since having civil rights is part of being human, they should not be abolished or even be limited.

  12. Concurring Opinion

1.) Civil Rights are absolute freedoms. It protects the Filipino citizens against abuse. Since the Philippines is a democratic country, the constitution allows the citizens to exercise such rights.

2.) Not all times that we citizens are protected of these Civil Rights. In fact, it is the government that oftentimes removes this rights from us. For example are the people who rally in Mendiola. They are just socially concerned people who just wants to express what they feel but more often than not, the policemen who stops them usually hurts them, thus chaos.

3.) Implement a law setting limits on civil rights that are being exercised on certain places and times.

    1. State the rationale (reason for being) for the protection of civil rights.
Civil rights were created for people to have a certain degree of freedom so that the citizens are not blinded and silenced by the law.

    2. Explain why the rationale is flawed.
The rationale is flawed due to the fact that too much information dissemination is bad for the people. Too much information may mislead them to the truth. Also too much freedom of speech is bad because of some people abusing this right. Too much freedom of speech may lead to disputes and misinformation of the citizens.

    3. Propose an amendment. Justify your proposal.
A certain set of limitations should be proposed. People should only have the right to exercise the freedom of speech not to all national issues, only up to some extent. Some people just talk and yet they do not know the whole truth and that is what starts disputes. If they are able to have a say in these issues then might as well let them be the officials.

This article states the right of the citizens to voice out their opinions provided that it will not do harm to others. This is to protect citizens of this nation from abuse. Also, the government has the right to ban any activities of the people when they had exceeded the limits given by the government.

The rationale is flawed because some people abuse their right. Also, the government sometimes is the one who takes away this right from its citizens.

In this manner, we become aware and be involved in the world that we are in.

  22. Concurring opinion:

No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the Government for redress of grievances.

At times this power of freedom is being abused by the media. They’re freedom to say they’re grievances makes the people carried away that causes them to lose their trust in the government. Media news should be all about unbiased facts, assessments are left to the viewers instead of being imposed to them. Freedom without ethics is such a poison that can ruin the relationship between the government and the people.

I propose that the media ethics should be strongly imposed because the media has such strong influence over their viewers, and so they have a big responsibility to keep the information distribution unbiased, fair and correct.

    Dissenting opinion:

No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the Government for redress of grievances.

It is correct because the media is the easiest source of information that almost everyone can access. Freedom of the press gives the public eyes and ears inside and outside the government. It makes us aware of what is happening around the government which is our rights because we don’t just pay taxes to let them spend it without our eyes on guard.

Civil rights must be protected because we are not puppets in this system. We are people that they should serve and with all our rights we should voice out whatever unsatisfaction we experience. Protection of civil rights also prevents abuse in power for the goverment.

  23. Concurring opinion:
    1. State the rationale (reason for being) for the protection of civil rights.
    2. Explain why the rationale is flawed.
    3. Propose an amendment. Justify your proposal.

Freedom is the right of every person and no one must be able to violate that unless it does harm to another. The protection of civil exist to prevent the violation of the freedom of the people.

The flaw here is that freedom can and is abused. Therefore, sometimes there is a need to regulate it.

An amendment for this law is that limitations be made on the exercise of these civil rights such that it does not cause harm or interference to the freedom of others

    Dissenting opinion:
    1. State the rationale (reason for being) of the protection of civil rights.
    2. Explain why the rationale is correct.
    3. Justify why civil rights must be guaranteed protection.

Freedom is the right of every person and no one must be able to violate that unless it does harm to another. The protection of civil exist to prevent the violation of the freedom of the people.

Freedom is the right of every person and it is the government’s duty to ensure that no one takes this right away from anyone.

Civil rights must be protected because it is the only way the people can express their opinion to a governing body. If this is taken away, violation of other rights could occur without anyone being able to do a thing about it since no one has the right to even complain.

The rationale for this is the Philippines is a democratic country. However, we Filipinos were granted of too much freedom. A good example is the Philippine Media. Media has obviously taken control of the minds of most Filipinos. They are the most influential, and most of their dissipated information are false. Too much of this freedom must be controlled. Too much of anything may destroy any one of us.

    B. Dissenting Opinion
The rationale for this is the Philippines is a democratic country. It is a good thing that our calls can be heard. All of the sides may be heard, and the issues connected to these may be resolved fairly. That is why the civil rights of the people should be conserved.

Personal rights acquired by an individual by being a citizen or resident, or automatic entitlements to certain freedoms conferred by law or custom. Certain civil rights (such as the right to equality, freedom, good governance, justice, and due process of law) are inalienable like human rights and natural rights, whereas others (such as the right to hold a public office) depend on one’s conduct and can be lost.

People are given their right to freely express themselves. But there should always be a limit. Most people abuse their right. They don’t even think of the consequences that their action could bring to the nation and to their fellow country men. It also gives people different versions of truth makes the matters more confusing and difficult to deal with.

The best way to solve this problem is to set the limit freedom of expression. They should have the right to express themselves in a certain range. There should be law that states the limits of public demonstrations and freedom of speech.

It is right for people should be given the right to speech. We all have different opinions and point of views about different matters. One should not be stopped in expressing his/her ideologies.

It should be guaranteed of protection because more and more people abuse their rights. This abuse actually leads to violation of others rights.

  26. Concurring opinion:

    1. State the rationale (reason for being) for the protection of civil rights.

    – Civil rights are given to us as a protection so that we can live freely without worry.

    2. Explain why the rationale is flawed.

    – It is flawed because some abuses their freedom to express.

    3. Propose an amendment. Justify your proposal.

    – We need to be more careful and responsible to what we will going say. Do not abused our freedom to express.

    Dissenting opinion:

    1. State the rationale (reason for being) for the protection of civil rights.

    – Civil rights are given to us as a protection so that we can live freely without worry.

    2. Explain why the rationale is correct.

    – The rationale is correct because it helps each citizen to express themselves freely, especially in pointing out unjust actions or measures by the government.

    3. Justify why civil rights must be guaranteed protection.

    – It guarantees protection, since it gives us the chance to speak for ourselves. To do what is right, and what we think could make us all better. We all have our own rights, and this gives us the chance to exercise it.

  27. A. Concurring
The rationale of the protection of civil rights is to ensure the protection and rights of our Filipino people.
The rationale is flawed because Filipino people might abuse their freedom, because they are vested an absolute freedom. I believe that we should limit the freedom given to us because some might abuse it .
    B. Dissenting
The rationale of the protection of civil rights is to ensure the protection and rights of our Filipino people.
The rationale is correct because the civil rights were use to exercise the Filipino rights, to be able to act freely. I believe that each and every one of us can act freely because of the civil rights; we can do whatever our rights are. We should not abolish the civil rights.

  28. Concurring opinion:

The protection of civil rights was created for people to experience freedom in the sense that we are abused and not crippled by the law. In that way we are free to express what we really feel.

This rational is flawed because there is still a rising extrajudicial killing. More often than that, the government is to blame to some of these cases.

People should be more aware on what are their rights. A person only experiences true freedom if he/she also knows his limitations and responsibilities.

    Dissenting opinion:

The protection of civil rights was created for people to experience freedom in the sense that we are abused and not crippled by the law. In that way we are free to express what we really feel.

The rational is correct because it protects a person from abuse and lets him exercise his freedom without any obstruction by the government as long as it is considered to be legal.

Civil rights must be guaranteed protection because it is the only way we become free to express our feelings toward a situation which is in dire need of self expression. In that way, we are being heard, listened and protected from abuse by the government.

  29. Concurring opinion:
    1. State the rationale (reason for being) for the protection of civil rights.

The rationale for the protection of civil right is for anyone to have freedom to whatever they want to do for as long as it do not impose danger to public welfare, public moral, and public order.

    2. Explain why the rationale is flawed.

The rationale is flawed because if everyone has the freedom to speech and expression, they have also the freedom to abuse it.

    3. Propose an amendment. Justify your proposal.

To avoid the abuse of using this right, the bill should also limit the usage of such freedom of speech and expression.

    Dissenting opinion:
    1. State the rationale (reason for being) of the protection of civil rights.

The rationale for the protection of civil right is for anyone to have freedom to whatever they want to do for as long as it do not impose danger to public welfare, public moral, and public order.

    2. Explain why the rationale is correct.

The rationale is correct because any person is human that has his own mind and disposition. They must be given this right to let them use it to freely speak for their mind and opinions.

    3. Justify why civil rights must be guaranteed protection.

Truth can set us free but truth can also put us in danger. If you revealed some truth about criminal acts then you will be in danger. This is why this bill is passed to protect us from danger when we are speaking out our opinion and information about something or someone.

  30. Concurring opinion:

    1. State the rationale (reason for being) for the protection of civil rights.

-The protection of civil rights was created so that the civil right of any citizen to voice his/her political opinion or to form special groups be protected constitutionally as long as it does not impede someone else’s rights.

    2. Explain why the rationale is flawed.

-It is flawed because the conditions to which civil rights may be suspended is not clearly set.

    3. Propose an amendment. Justify your proposal.

-I propose that the conditions needed for a move to suspend all civil rights be more clearly set . This prevents politicians from silencing any opposing opinion by labeling it as a danger to the public.

    Dissenting opinion:

    1. State the rationale (reason for being) of the protection of civil rights.

    2. Explain why the rationale is correct.

-It is correct because it makes the impeding of these civil liberties a criminal offense by law.

    3. Justify why civil rights must be guaranteed protection.

-Civil rights must be guaranteed protection because they are the basis of a democratic government. They allow any citizen to take part in the running of his/her government by expressing his/her opinion.

Civil rights are rights that are bequeathed by nations on those within their boundaries, while natural or human rights are rights that many scholars claim that individuals have by nature of being born. These rights are to be exercised by an individual through freedom of speech, of expression, and of press unless proven beyond reasonable doubt that it poses a “clear and present danger” to public welfare, public morals, and public order. The government sometimes restrains the civil rights of people for the reason of being an enemy or threat to the President. They suspend the writ of habeas corpus which means violation of civil rights is unavoidable. Everyone has his own power and rights but the government can suspend them if they want to. Limit the law that enables the government to suspend the writ of habeas corpus by amending it with certain conditions for the law to be viable. The Human Rights Protection Act should be expanded in order to protect its people from violations expansively.

    B. Dissenting opinion:
Civil rights are rights that are bequeathed by nations on those within their boundaries, while natural or human rights are rights that many scholars claim that individuals have by nature of being born. These rights are to be exercised by an individual through freedom of speech, of expression, and of press unless proven beyond reasonable doubt that it poses a “clear and present danger” to public welfare, public morals, and public order. Every individual has his own certain indissoluble rights which are life, liberty, and the pursuit of happiness. His civil rights are bound to be acknowledged and cosseted from anarchic actions which could jeopardize his life. The government should not obstruct with his freedom unless he poses a lucid and present danger to the nation. Civil rights delineate a democratic government. In a democratic government, the people have the freedom of speech and expression. Civil rights must pledge security for without these rights, anyone can estrange anyone, and the country will be disordered.

  33. A. Concurring Opinion

The rationale for the protection of civil rights is for citizens of the nation protected from abuse. A civil right gives a person do whatever he wants freely. It is flawed because there are times that the government itself takes away the freedom the civil rights has given a person. I recommend that there should be limitations when a person should neglected with his civil rights. People must be protected with their civil rights as long as they are doing thing that law allows them to do.

    B. Dissenting Opinion

The rationale for the protection of civil rights is for citizens of the nation protected from abuse. A civil right gives a person do whatever he wants freely. The provision is correct because it is right for a person to have his freedom to do anything as he wants as long as it is not against the law. The civil rights must be guaranteed protection because these are gives a citizen freedom. A democratic government implies civil rights. This is by giving a means of freedom to its citizens.

  34. A. Concurring Opinion

The Philippines is a democratic country and it places its people under its civil rights. The people are given their own freedom and free will to do their own bidding as long as it falls into the moral standard of the society. It gives us the right to what we like to say or do giving us freedom of speech.

The rationale is flawed because sometimes the government abuses the freedom of speech of the people. They control the actions of individuals that would favor the government and make themselves fresh to the public. However this removes the freedom of the people to say what is right and wrong and to give their outright opinion.

A designated limit should be implemented as to when a civil right is to be used so that it will not be abused. Without limitations, there will be many loopholes as to how to use a civil right. Provided with many loopholes, abuse comes into play.

    B. Dissenting Opinion

The rationale for the protection of civil rights is to protect the citizens, specifically every individual from abuse. A civil right is the sole right that makes a person do something freely.

The rationale is correct because a civil right should be innate and cannot be removed. We are given freedom to do what we want since we were born provided that we do it according to what is right.

The civil rights must be guaranteed protection from abolishment and abuse. As this is the right that makes people do something freely from their own freedom and free will.

  35. A. Concurring opinion:

    1. State the rationale (reason for being) for the protection of civil rights.
    >Every citizen has this so-called civil rights from the date of birth. These rights must be exercised and done freely without limitations. It protects every citizen from abuse be it physically or morally.

    2. Explain why the rationale is flawed.
    >The rationale is flawed for not every citizen is protected from it. It is the government itself who interferes with the rights of the citizens. They are much in control of us whenever they want to.

    3. Propose an amendment. Justify your proposal.
    >Limitations of civil rights must be implemented for some use it as an excuse or alibi on everything they are doing. Some are using it to extent that they are already abusing their rights.

    B.Dissenting opinion:

    1. State the rationale (reason for being) of the protection of civil rights.
    >Every citizen has this so-called civil rights from the date of birth. These rights must be exercised and done freely with out limitations. It protects every citizen from abuse be it physically or morally.

    2. Explain why the rationale is correct.
    >The rationale is correct for we are in a democratic country and civil rights must be exercised freely, without limitations and no one is allowed to intervene on such matter.

    3. Justify why civil rights must be guaranteed protection.
    >Civil rights must be guaranteed protection for it defines that we are in a democratic nation. Thus people exercise their rights freely, a way protecting ourselves from being abused, from other people and from the government itself.

  36. A. Concurring Opinion:

The civil rights is made to ensure the freedom of each and every person and to protect every individual from abuse. It is also the protection of everyone to freely express themselves but without violating the freedom of others.

The rationale is flawed because some abuses this right, especially the freedom of speech. People oftentimes use the media to influence other people and to gain favor. Our government sometimes also abuses the media to mislead people from the truth.

It would be better if the people know what their rights are and to know the true meaning of freedom but that is impossible, so setting limitations on the rights and freedom of the people would be the only solution. This will avoid the abuse of freedom.

    B. Dissenting Opinion:

The civil rights is made to ensure the freedom of each and every person and to protect every individual from abuse. It is also the protection of everyone to freely express themselves but without violating the freedom of others.

The rationale is correct because every person is born free and their rights are innate, it is not imposed by others. We can do anything that pleases us given that we do not violate the freedom of others.

The civil rights must be guaranteed protection because this is what protects our freedom as individual. Civil rights serve us our protection from any binding chains that restrain our freedom.

  37. Concurring opinion:

    1. State the rationale (reason for being) for the protection of civil rights.
-The Bill of Rights is the ultimate Defense of people under the jurisdiction of our law. The bill states that we have the freedom of speech, expression and freedom to express our grievances.

    2. Explain why the rationale is flawed.
-The rationale is flawed because most of the time, this Bill of Rights are abused by those “maka kaliwa” to make hasty judgments with the government’s action, the Bill of Rights, unfortunately, may be a tool to bring the government down.

    3. Propose an amendment. Justify your proposal.
-The limits of the Bill of Rights must be ammended, it should be stated clearly the limitations of our freedom of speech, no expressions that intends to bring down the government must be abridged, because we need to protect our country from those who only have political wills for themeselves only.

    Dissenting opinion:

    1. State the rationale (reason for being) of the protection of civil rights.
-The Bill of Rights is the ultimate Defense of people under the jurisdiction of our law. The bill states that we have the freedom of speech, expression and freedom to express our grievances.

    2. Explain why the rationale is correct.
-The rationale is correct because it PROTECTS us, commoners from abuse of authorities and to protect our right of freedom, as members of a democratic society.

    3. Justify why civil rights must be guaranteed protection.
-Civil Rights, must of course be protected because doing so, the individual rights of our people is defended against any actions restraining our freedom.

  38. Concurring opinion:
    1. State the rationale (reason for being) for the protection of civil rights.
Civil rights are absolute freedoms. Protecting it is protecting the freedom of the people.
    2. Explain why the rationale is flawed.
It is flawed because there are times the the ones who should protect the civil rights of the people are the one who is endangering it.

    3. Propose an amendment. Justify your proposal.
There should be a clear line when civil rights are crossed. And when this happens, proper sanction should be done.
    Dissenting opinion:
    1. State the rationale (reason for being) of the protection of civil rights.
Civil rights are absolute freedoms. Protecting it is protecting the freedom of the people.
    2. Explain why the rationale is correct.
If the government will protect the civil right of the people it is also preserving their freedom. The people are being free when they can exercise their rights and being able to live free from danger knowing that their best interests are being protected.

    3. Justify why civil rights must be guaranteed protection.
Civil rights should be protected precisely because it is protecting our people, our civilization. The people are the most important unit of a government and its people should be able to exercise their freedom.

  39. Abolish Civil rights of speech, expression, the press and association.

    A. Concurring Opinion:

The people have civil rights to speech and expression. These rights pertain to the freedom to utter or publish whatever one pleases and to be protected as long as it does not violate the law or other people.

The rationale is flawed. The freedom of expression is not absolute since this freedom is still subject to a guideline prescribed by the state. The state can still decide whether the abridgement of the freedom is to be considered due to a higher purpose such as protecting the peace of the country.

The legislative body can amend this flaw by proposing a list of lawful communication of ideas and ways when the state can violate such freedom.

    B. Dissenting Opinion:

The people have civil rights to speech and expression. These rights pertain to the freedom to utter or publish whatever one pleases and to be protected as long as it does not violate the law or other people.

The rationale is correct. The freedom of expression is important to liberty of the people. This freedom should not be deprived since man has free will.

It is important that person has such freedom. Such guarantee promotes the growth of an individual because he is free to communicate his ideas and it also allows the possibility of scrutinizing the acts of politicians.

  40. Concurring Opinion
1.) The rationale for the protection of civil rights is to take care of the citizens and defend them from abuse. A civil right gives us freedom.
2.) Most of the time, it is the government who takes away the freedom from us. They limit what we can do. There’s no sense in making a Bill of Rights if they will only take it away when they want to.
3.) Set boundaries and situation for when will the civil rights be ignored. They must know that they are free to do things as long as it abides laws and does not conflict with the freedom of others.
    Dissenting Opinion
1.) The rationale for the protection of civil rights is to take care of the citizens and defend them from abuse. A civil right gives us freedom.
2.) The rationale is correct because it enables each citizen to express themselves freely, especially in seeking justice or correcting the unreasonable measures made by the regime.
3.) Civil rights is the reason why we are still living. Without it, the military can just declare an all out war to the people in the slums or those who broke the law. There won’t be any prisoners, they will just be killed, and lastly, no more justice.

  41. Concurring opinion:
    1. State the rationale (reason for being) for the protection of civil rights.

Everyone has the freedom to to express their ideas and emotions no one is to have he power to take an individuals freedom away from them thus the rights should be protected like living persons.

    2. Explain why the rationale is flawed.

Some people who have the authority without reason takes away a person freedom for their own benefit and discards that person rights so as for them to gain what the need which is not good because they are abusing their power without abiding by the law.

    3. Propose an amendment. Justify your proposal.

I propose that there should be a limit on how much freedom they can remove from a person but also make the person acknowledge the limits of his freedom and for them to abide by the laws on which this freedom is protected in.

    Dissenting opinion:

    1. State the rationale (reason for being) of the protection of civil rights.

Everyone has the freedom to to express their ideas and emotions no one is to have he power to take an individuals freedom away from them thus the rights should be protected like living persons.

    2. Explain why the rationale is correct.

Each citizen decides for his/her own decisions in life no other individual is to interfere with what each of them desires from which makes up their whole being as an individual therefore it must be protected.

    3. Justify why civil rights must be guaranteed protection.

Civil rights give each individual a sense of being themselves through which they decide on how to live on their lives and if it should be removed then there is no sense to creating the government on which their responsibility is to protect the freedom of its citizens.

  42. Concurring opinion:

    1. State the rationale (reason for being) for the protection of civil rights.
    – The very heart of democracy is for each person to have the freedom to exercise his rights to freely express himself. Without civil rights, there can be no democracy. Civil rights are often considered to be natural rights Thomas Jefferson wrote in his 1774 ” A Summary View of the Rights of British America” that “a free people claim their rights as derived from the laws of nature, and not as the gift of their chief magistrate.”

    2. Explain why the rationale is flawed.

    – Civil rights are essential, but they come with responsibility. Without proper regulation, the practice of civil rights may be abusive. This, in turn can cause an infringement of rights of other people.

    3. Propose an amendment. Justify your proposal.

    – There should be a regulation of civil rights to some extent. Case in point: the freedom of speech should have more stringent parameters. At the present, anyone can toe the line between slander and libel without having the sensibility to think about the rights of others. The boundaries should be clearer and the implementation fiercer.

    Dissenting opinion:

    2. Explain why the rationale is correct.
-Civil and political rights need not be codified to be protected, although most democracies worldwide do have formal written guarantees of civil and political rights. This is because civil rights are considered as natural rights; it cannot be taken away from anyone.

    3. Justify why civil rights must be guaranteed protection.
    – The protection of civil rights is a basic tenet of democracy; without it, democracy cannot exist. It is imperative that the civil rights of a person be protected from infringement.

As a person we have rights. One of them is the freedom of speech. We should exercise this right because it is inevitable in our lives. Freedom of speech gives us a weapon and a shield. A weapon to fight for our right and freedom and a shield to defend that.

In the Philippines, this right exercise without the right limitation. Though it is right for people to have this freedom they tent to abuse it. This leads for unmoral action that leads to disputes.

The law about civil right on freedom of speech should be revised considering the limitation of morality and justice. This will not limit the freedom but regulate to the extend on what is a common good for all.

The law about the the freedom of speech should not be abolish. Removal of such important and inevitable law should not push through.

If abolish, this can lead to abuses of power. Political leader may do what ever they and people will not have say in it. People cannot express what they think and what the know is right. This discriminates people and void them of what is right for them.

    2. THE RATIONALE IS FLAWED BECAUSE…
… the media has great impact to the people, and sometimes, their satirical remarks somehow cause the mass to lose respect to some powerful people, including the people in the government. This way, some influential often lose their credibility over some petty issues.

    2. Explain why the rationale is flawed.

    >> It is flawed because too much freedom leads to abuse. Some people may abuse their rights and freedom of speech and expression. They can use these rights improperly.

    3. Propose an amendment. Justify your proposal.

    >> Certain limits to these rights and freedom must be expressed. In this way, the State would not take away the freedom of speech and expression to the citizens, but would only set limits so they could not abuse it. Too much of something is bad, and too much freedom leads to abuse of it.
